1. Preamble and General Provisions

The Operator provides, under the domain https://hungrycat.io, a digital, interactive online game in which users may extend the lifespan of a Virtual Cat and unlock additional individual in-game rewards through the purchase of Digital Products.

1.2 Formation of Contract and Applicability
These Terms and Conditions govern the use of the Service as well as all associated purchases. By using the Service and making payments, the user confirms that they have read and fully accept these terms.

1.3 Definitions
Service: The platform https://hungrycat.io including all digital content, features, and services.
Virtual Cat: The central game element whose global lifespan is affected by the purchase of Digital Products.
Remaining Duration: The remaining global lifespan of the Virtual Cat, which is extended by purchases.
User Account: The account—registration of which may be required—through which the user participates in the Service.
Digital Products: All digital goods available for purchase, in particular digital feed as well as cosmetic enhancements (Skin Rewards) that confer individual benefits to the User Account.
Skin Rewards: Individually usable cosmetic enhancements that are unlocked as a reward based on a personal score.

2. Description of the Service

2.1 Functionality
The Operator provides an interactive online game in which all users participate together in extending the global Remaining Duration of the Virtual Cat. The current Remaining Duration is displayed on the homepage https://hungrycat.io/.

2.2 Interpretation of the Offer
Within the framework of the game, users purchase Digital Products, in particular feed.

Digital Feed Purchase:
The purchase of digital feed constitutes a clearly defined commercial transaction. With each purchase of feed, the global Remaining Duration of the Virtual Cat is extended.

Individual Benefit:
In addition to extending the Remaining Duration, a score is credited to the respective user, which entitles them to unlock Skin Rewards – unique cosmetic enhancements that remain permanently associated with the User Account.

Non-Donation Nature:
All purchases are made as the binding acquisition of digital goods with individually measurable benefits and do not constitute voluntary donations.

2.3 Temporary Goods and Non-Transferability
All purchased Digital Products (feed, Skin Rewards, etc.) are available solely via the respective registered User Account. Transfer or assignment to third parties is excluded. Access to the purchased digital content is available only during the duration of the online game.

2.4 Global Availability of the Game
The extension of the Virtual Cat is global – meaning that all users benefit from each purchase. Should the global Remaining Duration expire, access to the Service will be restricted or terminated for all users simultaneously. No claim for a refund exists if a purchase is made shortly before expiration or if technical delays affect the processing of the transaction.

3. Payment, Right of Withdrawal, and Tebex as Merchant of Record

3.1 Payment Processing
The user represents that all information provided during the payment process is correct and that they are authorized to use the payment instrument.

3.2 Right of Withdrawal
By completing a purchase, the user expressly acknowledges that the service commences immediately. Since all payments are processed via our Payment Service Provider (see Clause 3.3) and the digital content is provided without delay, the right of withdrawal is waived for purchases executed under these conditions. No separate right of withdrawal notice is provided.

3.3 Tebex as Merchant of Record
We partner with Tebex Limited (www.tebex.io), who are the official merchant of digital content produced by us. If you wish to purchase licenses to use digital content we produce, you must do so through Tebex as our licensed reseller and merchant of record. In order to make any such purchase from Tebex, you must agree to their terms, available at https://checkout.tebex.io/terms. If you have any queries about a purchase made through Tebex, including but not limited to refund requests, technical issues or billing enquiries, you should contact Tebex support at https://www.tebex.io/contact/checkout in the first instance.

4. Copyright and Intellectual Property

4.1 All content—especially text, graphics, logos, images, videos, and designs on the website—is subject to German copyright law as well as other applicable intellectual property laws.

4.2 Any reproduction, modification, or distribution requires the express written consent of the rights holder, unless otherwise provided by law.

5. Limitation of Liability

5.1 The Operator shall be liable without limitation for intent or gross negligence, as well as for violations of life, body, or health.

5.2 In cases of slight negligence, the Operator shall only be liable if a fundamental (cardinal) contractual obligation is breached; in such cases, liability is limited to the typical, foreseeable damage.

5.3 In all other cases, liability is excluded to the extent permitted by law.

6. Miscellaneous Provisions

6.1 The current Privacy Policy, which the user has expressly agreed to at the time of registration, shall apply.

6.2 The Operator reserves the right to amend these Terms and Conditions at any time without prior notice. The current version is available on the website.

6.3 German law shall apply, unless mandatory consumer protection regulations of the user's country of residence prevail.

6.4 Should any provision of these Terms and Conditions be invalid, the remaining provisions shall remain in full force and effect.

7. Account Suspension and Code of Conduct

7.1 The Operator reserves the right to suspend or deactivate user accounts at any time and without providing reasons if unacceptable, offensive, or disruptive behavior is identified or if the proper operation of the Service is impeded.

7.2 Suspension or deactivation occurs at the sole discretion of the Operator, without any claims arising for the user.
